Chapter 7 Bankruptcy

Chapter 7 provides a complete elimination of most kinds of unsecured debt. Most people who qualify for Chapter 7 are still able to keep their cars, houses, and personal property. The law provides exemptions to protect your property up to certain values. We will help you determine whether any property may be at risk before we file anything. There is often a way to keep the property, even if it is not protected by exemptions. We will go over your property with you, and tell you of any concerns. Chapter 13 Bankruptcy

Chapter 13 provides a debt repayment plan through the appointed Chapter 13 Trustee. Essentially, you make payments to the Trustee, and the Trustee pays your creditors a portion of what is owed to them. Most payment plans last from 36-60 months, and at the conclusion of the plan the remaining unsecured debt is eliminated. Chapter 13 is appropriate for people who do not qualify for Chapter 7, or have property that they might lose if they filed Chapter 7. Chapter 13 can also be a great tool for repaying delinquent taxes and overwhelming student loans. Chapter 11 Bankruptcy

Chapter 11 provides a way to pay your creditors a portion of what is owed to them, usually without the involvement of a Trustee. Corporations and other business entities file most Chapter 11 cases, but Chapter 11 may be appropriate for some individuals under limited circumstances. Most individuals who file under Chapter 11 do so because they are ineligible for Chapter 13 due to the Chapter 13 debt limits. This is a very small segment of those seeking bankruptcy relief.
